THE ONLY MEANS for residents to defend themselves from unreasonable Park Owner activity and intimidation is to operate a Community Home Owner Association (HOA) as provided under law; with members paying dues.

Or to support and participate in the work of the 'PA Coalition of MH Residents" (PAMHOA).

The alternative is legal representation you cannot afford.

 

 

 

 

Right to Participate in a

Tenant Organization or Association

 

Participation in Tenants' Association -  68 P.S. § 250.205

No individual unit lease on residential property shall be terminated or non­renewed on the basis of the participation of any tenant or member of the tenant's family in a tenants' organization or association.  
 

“Tenants’ Organization or Association”  means a group of tenants organized for any purpose directly related to their rights or duties as tenants.  68 P.S. § 250.102

 

The Mid-Island Properties case570 A.2d 1070 (Pa. Super. 1990)

Tenant whose lease was not renewed was not protected under sec. 250.205, since he was acting just as an individual and was not part of any formal or informal tenants’ association.  This tenant’s acts were only a “personal crusade” and not part of a group effort.  There “was no organization or association of tenants. . .no coordinated functioning whole and no united effort by tenants.”

AS AN INDIVIDUAL RESIDENT YOU HAVE NO STANDING UNLESS YOU ARE ABLE TO PAY FOR A LAWYER.

 

WHERE YOU OPERATE A FORMAL "HOME OWNERS ASSOCIATION" (AND THIS IS EASY TO DO IF YOU HAVE SOME OFFICE OR BUSINESS SKILLS) WHEN  YOU CONTACT THE PARK OWNER YOU REPRESENT YOUR COMMUNITY.

 

MANY ISSUES AFFECT ALL COMMUNITIES AND ARE OF STATE-WIDE CONCERN AND CAN ONLY BE CORRECTED IN YOUR COMMUNITY WITH THE HELP OF STATE FACIILITIES OR CHANGES IN THE LAW, AND YOU CAN ONLY BE RIGHTLY RECOGNIZED IF YOU ARE ORGANIZED AS A HOA.

HOW DO I (or my community) GET STARTED? Check elsewhere on this site (go to: "MORE information on forming a HOA" - at left)...Residents of land-lease communities are proud Americans. As the largest block of unsubsidized affordable housing We DO NOT ask for handouts or charity. We only ask we are treated fairly, with respect, and have an equal opportunity to defend and protect our rights and property!                      

 

Here are some other reasons to do so.

 

Typically, Home Owner Associations include a combination of social gatherings, and taking time to work together to address issues of concern.

 

Many of the more serious concerns - such as “the threat of eviction” (we are mostly all under the risk of 30 DAY notice – not owning the land) - and “unjustified lot rent increases” can ONLY be addressed as a group.

 

Remember too, regardless of how nice or reasonable your community owner or manager is, they are secure, whereas you are constantly and permanently at risk – a situation more difficult to deal with over time, and events tomorrow could change everything. Renting land is a risky business - ask any farmer!

 

Nor do you need worries about where to site your home later in life – or if you can afford to live there.

 

What is more, in organizing a HOA, you are not slighting the owner but taking “reasoned responsibility” for your own affairs as you are required to do as a citizen.

 

There is an old adage “safety in numbers” - and this is true.

 

Also, where a real concern or issue arises in your community if two or three complain it is of little consequence. Where a majority of residents complain the owner must pay attention.

 

One simple remedy to help lessen the risk of Manufactured Home ownership is "Park Closure Insurance". Another, to limit rent increases on residents living on social security. However, even these simple provisions most of us need to see in place, may not occur without your help.

 

A HOA in your community can educate, network to inform people of their rights and responsibilities, and be a resource to help bring about needed changes in legislation.

 

REMEMBER, YOU ARE RESPONSIBLE.  Not your neighbor, not the Coalition or its board members, or even your State Representative - you must take action; but the Coalition can help you to do so.

WHY SUPPORT THE PA COALITION and its work:

 

IF you are unable for now to get together with a few friends and begin a Home Owners Association it is important to stay in touch and register your support with the “PA Coalition of Manufactured Home Residents” (PAMHOA).

 

We are working statewide to raise awareness of the many serious issues affecting owners of Manufactured Homes living in land-lease Communities (LLC)

 

Sadly in entering into a lease, you appear to loose many rights expected of home ownership. Elsewhere on this web-site the risks are discussed. The situations most home owners find themselves in is not untypical across the Commonwealth and the USA; importantly however, these circumstances CAN BE CHANGED, but residents must want to see change and among other things object to uncontrolled rents, living with the risk of 30 day eviction, and other serious concerns that would be considered outrageous by most people; if not found to be unconstitutional, in that you are entitled to better protections and to protect your personal property (your home) from destruction or being devalued or made worthless by existing policies or actions of others; and where the law does not sufficiently provide for your protection under today’s conditions and circumstance.

 

ALL 2000 Manufactured Housing Communities across the Commonwealth are at serious risk, just as your is, of closure or “change in use”, uncontrolled rent hikes, no place to re-site your home if needed, inadequate representation in Harrisburg, and more – concerns that can easily be corrected through resident support - support that requires little more than registering with your own HOA, or with the Statewide effort the “The PA Coalition of MH Residents”.

WHAT DOES THE COALITION DO?

 

1)      We are working to more effectively lobby in Harrisburg when needed.

2)      We work with State agencies to represent (lobby for) resident causes and improved legislation.

3)      We meet with legislators to discuss and encourage new law.

4)      We alert agencies to the presence of intimidation in communities and the need for better outreach to inform.

5)      We are building a network of HOA to increase communication and educate.

6)      WE NEED your support to help bring about change and introduce NEW facilities in the Commonwealth to better protect LLC residents and their property.

7)      There are close to ¾ of a million citizens living in 2000 communities across the Commonwealth and they are entitled to be responsibly represented and heard.
