IS THERE CONSPIRACY TO DEFRAUD PA’S SENIOR CITIZENS AND ELDERLY? 

 

Conspiracy: Plot, Scheme, or Plan.

 

Defraud: Deceive (misinform), Swindle (rip-off) Cheat, Trick, or Fleece (take for a ride)

 

 

It may appear so for citizens owning properties in many of PA's land-leased communities (LLC).

 

 

For more than twenty years alarm bells have been ringing and reports written concerning the unfair dealings faced by PA’s citizens owning homes sited in land-lease communities. Many of these homes are small and older, and can be moved relatively easily or using a tractor trailer; but just as many are substantial homes, modern in design, built to conventional home standards and cannot be moved without being partially dismantled and requiring special permits to be transported over the highway; and in fact the same structure that can be placed on a traditional foundation. And, did you know a conventional home or building can equally be lifted off its foundations and relocated? So called “modular homes” are factory built houses designed to be delivered to the home site partially assembled.

 

These homes range in size from 1200 SF to 2000 SF, and can cost to purchase between 100K to 200K. They represent a form of housing that is unique in offering ranch style living favored by retirees, the elderly, and those dealing with ill health or requiring wheel chair access; because they are modern, convenient, easy to maintain, and offer facilities suited to the disabled. The use of these homes promoted by the manufacture – but the concerns of ownership (as often occurs) not disclosed. A large number of these homes, are located in land–lease communities (LLC) and comprise an important component of PA’s affordable housing, and are owned independently of the land on which they sit; ownership cost helped by grouping into communities, and located in a rural setting where land is more economical.

 

However, you may find it surprising that these homes based on an outmoded concept of land use, are considered to be “motor vehicles” and not houses, the owner holding a motor vehicle title not a deed, but the homes in most respects marketed just like conventional houses. The homes in LLC are also subject to property taxes. The odd vehicle classification causes the homes to be falsely devalued and cost more to finance, and after a few years, without justification, the structure not deteriorated beyond any other stick built home - considered obsolete and of little value. This entire premise false and deceptive, and often leads the owners of these homes to be subject to duress and other abuses; outrageous circumstances seemingly encouraged by PA’s law and legal system. This results in the potential for the fleecing of low-income families, the elderly, and disabled.

 

This situation has been known for many years, and nothing done. Authorities, agencies, elected officials, and legislators, able to assist in fact doing little or nothing to change what is occurring. Needed legislative change has been denied for years. In addition, there is a well organized lobbying system in Harrisburg purposed to keep the owners of these homes denied what are believed to be their constitutional rights and fair treatment, so that many home owners are subjected to unreasonable leases, forced to accept disadvantageous lease terms under duress, and faced with ever increasing lot rent fees, not only making home ownership unaffordable but cheating the home owner out of their personal investment and security. No other category of housing is subjected to such abuse, or the planned destruction of value taking directly from the homeowner.

 

 

Once entering into ownership there is no practical remedy or defense. This is not a story of the American dream but an American nightmare. The circumstances described here are feudal in concept, seen by many as potentially being criminal and unconstitutional, and a condition just as unacceptable as “taxation without representation”, a system Americans rejected more than 200 years ago; Americans in the home ownership situations described here also subjected to tyranny and intimidation to enforce the conditions that exist.

 

The situation described is so serious and blatant against the interests of those citizens affected, that an immediate inquiry, prosecutions, or other substantive measure is immediately needed and justified to remedy; nor is the concept of compensation for home owners subjected to loss, and other inflated and excessive charges obtained under duress unreasonable.
